Hello! Welcome to my Commission Agreement/ Terms of Service.

Please make sure to read through everything. If you have any questions, please contact me.

Part 1 - General

1. I, Raxheli, reserves the right to refuse a commission without reason or explanation. Any inappropriate behaviour of any kind will be considered a breach of the Terms of Service. The customer may receive a refund based on how much of the commission is already complete.
2. If there is poor communication with the customer, then the commission will be pushed back until the next one is completed. I, Raxheli, also reserve the right to stop the commission as a whole.
3. The client understands that the artist, Raxheli, will not copy another artist’s style. It is recommended that the client go to the artist in question to get work done by them.
4. The client must read, understand, and agree to all the terms. By continuing with the commission and going forth with the payment, the client has agreed to the above terms.

Part 2 - Payments and Pricing

1. All prices are in USD.
2. Prices may change according to the detail of the piece at the discretion of the artist, Raxheli.
3. Personal and Media Commissions: Full payment takes place immediately before the artist starts to work on the commission. The client has 3 days to do so before the artist will move onto the next commission.
4. Business Work: Individual payment plans can be done depending on the piece and/or discretion of the artist.
—— If a designated portion of the price (between 10-20%) is the first payment for sketch approval. If the client doesn’t want to continue to work with the artist past that point, that amount is non-refundable. The remainder is due before the artist continues the process of completing the piece.
—— If a payment plan is agreed upon, the client may work with the artist on what to pay. The artist has the right to refuse.
5.All Commissions will be paid by invoice. Please make sure to provide the correct email for payment.
6. If the commission is needed by a specific deadline that is to be communicated to the artist in advance, the artist may apply a fee at their discretion.
7. Final prices stated by the artist are non-negotiable.

Part 3 - Process/Deadline/Communication

1. The client must provide clear and concise references/descriptions of their character(s) in order to avoid confusion. (See order form for more details)
2. Any written text or communication must be in English.
3. Clients may request changes during the sketching process. Changes applied after this check will require an extra fee depending on the complexity of said changes.
4. Final commission piece(s) will be sent through email. Please make sure to provide the correct email through the commission form.
5. The best platform for communication must be filled out in the form so that both the client and artist can have a reliable line of communication.
6. Personal Commission: Please make sure to allow up to 6 weeks for the commission to be completed.
7. Media/Business Work: Please make sure to allow up to 8 weeks for the work to be completed.

Part 4 - Rights

1. Personal Commissions: The commissioned piece may NOT be used for commercial purposes and cannot be redistributed or reproduced. The client may NOT make any profit off of the piece, which includes but is not limited to digital prints, physical items, etc.
— Emotes/Badges fall under this category.
2. Media/Business Work: The client may buy the rights to use the piece(s) to make profit will require an additional fee.
3. The artist retains all rights to the piece of artwork itself, including the right to display the art in a portfolio, on social media, or a personal website. A watermark will be used on the piece to lessen the chance of others claiming it.
4. Removing any artist watermarks is a violation of these terms.
5. The artist retains the right to crop, edit, or alter the image for promotional use.
6. The artist does not claim any rights to any intellectual property or the character(s) that belong to the commissioner.
7. The client may not alter or edit the piece of artwork itself unless agreed upon by the artist.
8. The piece(s) may be reposted to the client’s platforms of choice so long as full credit is given to the artist.
9. The client may not claim the commissioned piece as theirs in any way, shape, or form.
10. The commissioned artwork may not be resold.
11. The artist is not responsible for providing the client with a physical object, print, merchandise, etc. of the artwork, unless agreed upon in which a fee may be applied.
12. The client may print a copy of the commissioned artwork for personal use if provided with written consent by the artist. It may not be redistributed or sold in any way.
13. The commissioned piece and any form or part of it may NOT be used for NFT or any service/product/transaction related to NFT. You may not reproduce or alter the image in any way, no matter how unrecognizable it may become, for use in any NFT related purposes. No derivatives of the commissioned piece may be made into/minted/sold as NFT. This also applies to any commissions in the past and future from the artist to any and all clients.

Part 5 - Refund Policy

1. If the client wishes to cancel the commission before payment, there are no repercussions. The commission will be cancelled and no further action needs to be taken.
2. If the client wishes for a refund before beginning any work, a full refund will be provided.
3. If the client wishes for a refund after beginning any work, a percentage of the refund will be provided at the artist’s discretion based on how much work is done.
4. If the client wishes for a refund after the commission is completed, no refund will be provided.

Part 6 - Other

1. By providing the client with a line of communication to the artist, the client agrees to act in a professional manner.
2. The client may not redistribute the artist’s contact in any way unless agreed upon by the artist in advance.
3. Should any terms of service be breached, or the artist incurs damages caused by the client, the artist reserves the right to either issue a takedown DMCA notice or pursue damages through the Copyright Law of the United States (https://www.copyright.gov/title17/).
